NBN deal to shut rival Optus cable

Optus presently provides fixed-line services to about 504,000 customers on its HFC cable network, and around the same number on its infrastructure which piggybacks on the Telstra copper network.

The deal will give Optus boss Paul O'Sullivan the promise of a bundle of cash as he transfers customers across to the NBN, and also puts him in a difficult position as he attempts to fine-tune the final ACCC decision on the deal.

Given his nose will also be in the trough, it's harder to say someone else's nose is dirtier.

Telstra made the shutdown of the cable one of the conditions to its participation in the deal.

Both companies in theory will be open to more competition because on a new network there will be less reason to stay loyal to one or another.

That explains why Telstra is spending up big to lock customers into long-term bundled deals.

The forced shutdown of a rival service adds to doubts over the NBN deal from a competition policy perspective, given its creates one government-owned monopoly to break up and replace another dominant supplier (Telstra) and in the process eliminates another competitor.

From a competition policy perspective, the deal breaks about every rule in the book, but it is being justified on the grounds it is creating more household service competition down the line.

The analogy is something like a monopoly road which encourages a string of new retail outlets to service the trade.

That's the theory. Given the deal is the government's one big popular national reform, it would take a very brave competition regulator to knock it back.

The present ACCC boss Graeme Samuel is on the record as supporting the deal because it achieves the long-sought-after structural separation of Telstra.

Incoming ACCC boss Rod Sims is an infrastructure policy expert who may take a different view if one ignores Samuel's argument that the ACCC is a team, and no single person sets the policy.

The Optus deal will differ from the Telstra deal in that it will be paid for by the customers as the NBN deal rolls past their homes, but NBN won't seize ownership of the infrastructure.

NBN will effectively buy Telstra's fibre to the exchange network, pay rent for the next 30 years on its cable ducts and compensation for customers transferred across to the NBN.

When you throw the Optus deal into the equation, NBN can reach some commercial footing sooner, with the increased certainty provided by more customers and zero competition increasing the stated internal rate of return from 7.01 to 7.04 per cent.
