Man set to begin his jail term facing drug charges

SYCAMORE – A man arrested for reportedly possessing heroin is in the DeKalb County Jail two weeks before he was scheduled to begin serving a jail term for violating sex offender registry requirements.

Kevin M. Krich, 29, a transient, was charged with unlawful possession of a controlled substance – a Class 4 felony punishable by up to three years in prison.

According to court documents, Krich and a co-defendant – Monica L. Anderson, 42, of the 700 block of South First Street in DeKalb – were in possession Feb. 3 of less than 15 grams of heroin.

Anderson was arrested last week and released from jail after posting $1,500 to satisfy a $15,000 bond. She is charged with unlawful possession of a controlled substance and obstructing justice for reportedly placing drug paraphernalia with heroin residue in a garbage can “with the intent to prevent the prosecution of Kevin Krich.”

Krich was arrested after a warrant was issued last week. He appeared at a bond hearing Monday at the DeKalb County Courthouse via closed-circuit TV from the DeKalb County Jail.

Krich told Associate Judge William Brady that he has no home address. Prosecutor Julie Trevarthen of the DeKalb County State’s Attorney’s Office said that is a violation of his probation because as a convicted sex offender Krich is required to register his home address.

Krich was scheduled to begin a 180-day term in the DeKalb County Jail on July 5 after he was resentenced in May for violating sex offender registry requirements.

Brady assigned a public defender to represent Krich and set bond at $15,000, meaning he will have to post $1,500 to be released. He ordered that Krich not be released, even if he does post bond, until he has served the sentenced that is set to begin July 5.

Krich’s next court date was set for Monday.

Immigration Law Expected to Head to Supreme Court

U.S. District Judge Thomas Thrash has scheduled a 10 a.m. hearing for several civil and immigrant rights groups to make their case for halting Georgia’s law.

The American Civil Liberties Union, National Immigration Law Center and others argue the law is unconstitutional and are asking Thrash to put the law on hold pending the outcome of a lawsuit they have filed to block it.

Thrash is also planning to hear a request from Republican state Attorney General Sam Olens to dismiss the ACLU’s lawsuit. Olens’ office argues the state and U.S. constitutions grant Georgia immunity from such lawsuits.

Thrash, who was nominated to the court by President Bill Clinton, recently indicated he could immediately issue his decisions Monday after telling attorneys in the case that he has been known to rule from the bench.

Whoever loses after Monday’s hearings is expected to appeal to the 11thU.S. Circuit Court of Appeals in Atlanta. The case could eventually make its way to the U.S. Supreme Court along with other legal challenges targeting similar laws in Arizona and Utah, said R. Keegan Federal Jr., one of the attorneys who is seeking to halt Georgia’s law.

“I do fully expect this one to end up there” at the U.S. Supreme Court, said Federal, a former DeKalb County Superior Court judge. “But I don’t think it will end up there all by itself.”
